1. GENERAL INFORMATION
1.1. Mytrack srl reserves the right to apply to one or more orders (hereinafter the "Order") specific contractual provisions that will be reported in the summary before the confirmation of the same by the Customer (hereinafter the "Specific Forecasts"). In this case, the contractual conditions applicable to the single Order will be both the General Conditions and the Specific Forecasts. 1.3. The Products are sold directly by Mytrack srl (limited liability company), a company incorporated under Italian law, (CF: 02494330976) with registered office in Prato via Genova 17/7.
1.4. Mytrack srl may at any time modify or amend these General Conditions. The changes will be effective from the moment of their publication on the Site, it being understood that any Orders already accepted by Mytrack srl will continue to be governed exclusively by the General Conditions and by the Specific Forecasts in force at the time of the conclusion of each Order.
3. COMMERCIAL POLICY - RESTRICTIONS ON SALE AND DELIVERY OF PRODUCTS
3.1. The Products are offered for sale exclusively to natural persons who act for purposes that do not fall within the framework of their commercial, industrial or professional activity (hereinafter the "Customers").
3.2. In consideration of the above, Mytrack srl reserves the right not to process orders from subjects other than Customers and to provide, for each category of Product, a maximum number of Products that can be purchased.
3.3. The Customer acknowledges and accepts that the Products may only be shipped to the countries listed in the article.
3.4 The billing address and the shipping address must be within the same country.
3.5. The Customer acknowledges and accepts that, for security reasons, no shipments of Orders addressed to a post office box or to non-identifiable recipients and / or addresses will be made.
3.6. All communications to the Customer will be made by Mytrack srl to the e-mail address indicated by the Customer during registration or when purchasing if the Customer checks out as a guest. Any changes to this address must be communicated in writing to Mytrack srl without delay.
4 METHOD OF PURCHASE
4.1. Each Product offered for sale is described and viewable on the Site where there are photographic images of the Products, the relative unit price including VAT, the colors and the different sizes, measures and / or formats available (where applicable).
4.2 Although Mytrack srl adopts measures and precautions aimed at ensuring that the photographs shown on the Site are faithful reproductions of its Products, some variations are always possible due to the technical characteristics or color resolution of the Customer's computer. Consequently, the images and colors of the Products offered for sale may, in some cases, not correspond to the real ones. The images and colors, therefore, must be considered as indicative and exemplary. Mytrack srl will therefore not be responsible for any mismatch of the images or colors of the Products due to the aforementioned reasons. 4.5. Before the Customer confirms the Order, the latter can always be modified or corrected. The confirmed Order will not be further modifiable, but can only be canceled, except when provided for in the article of these General Conditions and by mandatory provisions of law.
4.6. At the end of the purchase procedure, it is advisable to download, save or print all the conditions of the Order including the General Conditions in force on the date of conclusion of the same. The Customer will also receive an e-mail confirming receipt of the Order placed, containing a summary of the information already reported in the Order form (i.e. Customer data, shipping methods and addresses, an indication of the model, color and the size / measurement of the selected Products, the indication of the price and any delivery costs).
4.7. Customers who have registered on the Site will be able to monitor the status of their Order at any time by entering "My Orders", within the "Account" area. In any case, the status of the Order will be monitored for all Customers who purchase on the Site by contacting Customer Care using the contact form or on the Site.
4.8. Each Order confirmed by the Customer will be sent automatically to Mytrack srl and will be filed at the operational headquarters of the same, located in Prato via Genova 17/7.
4.9 The customer has the option of "pre-ordering" the goods when the order is sent, the item is finished. This option is indicated with the pre-order name containing an indication of the term within which the product will be available.
5. PRICES AND PAYMENT METHODS
5.1. The prices of the Products indicated on the Site are expressed in EURO and inclusive of VAT.
5.2. The total amount of each Order will also include the shipping costs calculated as specified in point 8 "Shipping Costs" below.
5.3. Mytrack srl reserves the right to change the prices of the Products offered for sale at any time and without notice. The changes will take effect from the moment of their publication on the Site, it being understood that the prices in effect at the time of the conclusion of each order will continue to be applied to the Orders already confirmed by the Customer.
5.4. Payment for Products purchased on the website www.mytracksuit.it can be made by cash on delivery or credit card. The accepted credit cards are those indicated in the appropriate section of the Site "Method of Payment". All prices are exclusive of delivery costs. The total cost of the order is the price of the products ordered, plus the cost of delivery except for deliveries within the national territory, as delivery is free.
5.5. Prices may change at any time, but (apart from the above) the changes will not affect orders for which we have sent an Order Confirmation. Once all the items you want to purchase have been selected, they will be added to the cart. The next step will be to process the order and make the payment. 5.6 Payment for Products purchased through PayPal: Mytrack srl uses the electronic system protected and guaranteed by Paypal. Purchases made through all the circuits that Paypal itself will be integrating will be possible. We can only ship to the address indicated by Paypal.
5.7 The credit cards accepted are those indicated in the appropriate section of the Site "Method of Payment".
5.8. Payment transactions by credit card will be governed by the regulations adopted by the individual credit card circuits also with regard to spending limits.
5.9. The confirmation of the successful outcome of each Order will take place only after verifying the credit card data and following the receipt of the debit authorization by the issuing company of the credit card used by the Customer to debit this card. of credit. 5.10. 6. AVAILABILITY OF PRODUCTS PURCHASED ON THE SITE

7. TRANSPORT AND DELIVERY
7.1. Mytrack srl undertakes to process each confirmed Order within 24 working days starting from the business day following the one on which the Customer sent the Order, except in unforeseeable and exceptional unforeseen circumstances. During the periods of company closure, the delivery times indicated above may be subject to postponements.
7.2. When the Products are shipped, the Customer will be informed by email.
7.3. Customer Care is available to the Customer to provide assistance on the status of the Order and for any problems relating to delivery. However, the service may be subject to delays and / or interruptions during periods of company closure.
7.4. Shipments are made by courier: Alpiexpress (with Fedex, UPS, TNT and Bartolini)
7.5 Mytrack srl ships from various warehouses. For orders with more than one item, it is possible to divide the order into multiple packages, based on stock levels, at our discretion. 7.6 Delivery to the carrier constitutes delivery to the Buyer, and subsequently, the risk of loss or damage passes to the Buyer. Any claim by the Buyer relating to damage during shipping or delivery should be made directly to the carrier. Any claims by the Buyer against Mytrack srl for deficiency or damage occurring before such delivery to the carrier must be made within five (5) days after receipt of the goods and accompanied by the original transport invoice signed by the carrier noting that the carrier has received the goods from Mytrack srl in the required condition. 9. RIGHT OF WITHDRAWAL
9.1. The Customer has the right to withdraw, in whole or in part, from each Order, no later than the term of 14 days, starting from the day of receipt of the Products. 9.2 In case of exercising the right of withdrawal for purchases made through the Site, the Customer must return the products to Mytrack srl within the aforementioned period of 14 days, delivering them to the courier that MyTrack srl will send.
9.3 The Product must be returned to the courier in its original state with the identification tag, still attached, and packaging, after being carefully placed in the box in which it was delivered and carefully closed with adhesive tape. The product must not have been used or tampered with. Otherwise, the withdrawal is considered incorrectly exercised.
9.4 For the return, the shipping cost is € 15.00 for Italy.

9.5. If the withdrawal is not exercised in the manner indicated above, Mytrack srl will not accept the returned Products and will return the Products to the Customer without additional shipping costs.
9.6. If, on the other hand, the withdrawal is validly exercised, Mytrack srl will re-credit the amounts corresponding to the value of the returned Products as quickly as possible and in any case within 14 days from the date of receipt of the Products.
9.7 My Track srl reserves the right in any case to withhold the refund until the Product has been received and verified or until the Customer proves that he has returned the product correctly and in intact condition, taking into account the situation that occurs first.
10. Product Replacement
For the purpose of exchanging the Products, the Customer must inform the Customer Care by email: firstname.lastname@example.org who will take action to register the exchange request. The purchased products can be replaced, at the request of the Customer, no later than 14 days from receipt of the ordered products, with others of the same model, changing size, according to the same return procedures indicated in the previous articles, at a cost of € 15, 00 for Italy.

10.1 Conditions of integrity for the return
According to the provisions of Article 57 of the Consumer Code, the consumer is responsible if the products returned by the Customer are damaged, incomplete, deteriorated and / or used in a manner that does not comply with normal diligence. In such cases, Mytrack srl will promptly notify the Customer of the damages and non-conformities found upon receipt of the items. The sum charged to the Customer, which in any case cannot be higher than the price paid for the purchase of the item, will be reduced.
11.1. The Products are covered by a legal guarantee of conformity pursuant to articles 128 and ss. of the Legislative Decree 206/2005 ("Consumer Code). This guarantee is reserved for customers. Mytrack srl is therefore responsible towards the Customers for any lack of conformity existing at the time of delivery of the Products and which occurs within two years from the delivery of the Products. In this case, the Customer has the right to restore, without charge, the conformity of the Products by repair or replacement or to an appropriate reduction in the price or to terminate the contract in accordance with the terms and conditions set out in art. 130 cod. cons.
11.2. The Customer loses the aforementioned rights if he does not report the lack of conformity to Mytrack srl within 8 days from the date on which he discovered it. The direct action to assert the defects not maliciously concealed by Mytrack srl is prescribed, in any case, within twenty-six months from the delivery of the goods.
11.3. The costs necessary to make the Products conform to the contract, including shipping costs, will be borne by Mytrack srl.
11.4. For the purpose of returning the defective Products, the Customer must inform, by telephone or by email (email@example.com ), the Customer Care, who will activate the practice.
11.5. The Customer must return the defective products to Mytrack srl by delivering them to the courier for shipment.
11.6. The Products, as far as possible, must be returned in their original condition and packaging with the identification tag still attached.
12. PERSONALIZED PRODUCTS
12.1. Pursuant to and for the purposes of article 59 c), Legislative Decree 206 of 6 September 2005 ("Consumer Code"), the right of withdrawal, cancellation or return is excluded in the case of Orders relating to customized products or clearly personalized.
